Introduction and Acceptance of Terms
These Terms of Service (“Terms”) constitute a legally binding agreement between you (“User,” “you,” or “your”) and MobileGabbai (“we,” “us,” or “our”), governing your access to and use of the website at MobileGabbai.com and all related services (collectively, the “Service”).
BY CREATING AN ACCOUNT OR USING THE SERVICE, YOU AGREE TO THESE TERMS. IF YOU DO NOT AGREE, DO NOT USE THE SERVICE.
1. Eligibility
To use the Service, you must:
- Be at least 13 years of age (or the age of majority in your jurisdiction, whichever is greater)
- Provide accurate and complete registration information
- Successfully complete email and phone number verification
- Not be prohibited from using the Service under applicable law
2. Account Registration and Security
2.1 Registration Process
Creating an account requires:
- Email address verification via a 6-digit one-time code (valid for 15 minutes)
- Phone number verification via SMS one-time code (valid for 10 minutes)
- Optional profile completion (name, username, location, bio, gender)
2.2 Phone Number Requirements
You must provide a valid, physical mobile or landline phone number registered in your name or that you are authorized to use. The following types of phone numbers are expressly prohibited:
- VoIP numbers (Google Voice, Skype Number, Vonage, etc.)
- Virtual or app-based numbers (TextNow, TextFree, Burner, etc.)
- Temporary or disposable SMS numbers
- Internet-based phone numbers of any kind
We use third-party phone validation services (Twilio Lookup) to detect and reject prohibited number types. Attempting to circumvent this restriction is a violation of these Terms and may result in permanent account termination.
2.3 One Account Per Person
Each person may maintain only one account. Creating multiple accounts to circumvent bans, verification requirements, or for any other purpose is prohibited.
2.4 Account Security
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at hello@MobileGabbai.com of any unauthorized use. We are not liable for losses resulting from unauthorized use of your account.
3. SMS Messaging Terms
3.1 Consent to Receive SMS
By completing phone verification, you consent to receive SMS messages from MobileGabbai for account verification and security purposes. By opting in to notifications, you additionally consent to receive informational SMS messages about Minyan events and community activity.
3.2 Message Frequency
Verification messages: sent only when you request them (registration, login, account recovery). Notification messages: frequency varies based on your settings and local Minyan activity, typically no more than a few messages per day.
3.3 Message and Data Rates
Message and data rates may apply. All SMS charges are billed by your mobile carrier according to your plan. We do not charge separately for SMS messages.
3.4 Opt-Out
To stop receiving SMS notifications, reply STOP to any message or update your preferences in account settings. After opting out, you will receive one final confirmation. Verification messages cannot be disabled while your account is active.
3.5 Help
For assistance with SMS messages, reply HELP to any message or contact hello@MobileGabbai.com.
3.6 Supported Carriers
Major US carriers are supported including AT&T, Verizon, T-Mobile, Sprint, and others. Carrier availability is not guaranteed for all areas or plan types.
4. User Content and Minyan Listings
4.1 Your Content
You may post Minyan listings, event information, profiles, comments, and other content (“User Content”). By posting User Content, you grant us a non-exclusive, worldwide, royalty-free license to display, store, and distribute that content as part of operating the Service.
4.2 Content Standards
All User Content must be:
- Accurate — event times, locations, addresses, and schedules must be correct to the best of your knowledge
- Relevant — content must relate to Jewish community events, Minyanim, or related community activity
- Lawful — you must have the right to post any content, including photos and venue information
- Respectful — content must not harass, demean, or target individuals or groups
4.3 Prohibited Content
You may not post content that:
- Is false, misleading, or fraudulent
- Contains spam or commercial solicitations unrelated to the Service’s purpose
- Infringes any intellectual property or privacy rights
- Contains malware, viruses, or harmful code
- Violates any applicable law or regulation
- Includes personal information of others without their consent
4.4 Venue and Address Information
When posting a Minyan location, you must have authorization to publish that address. Do not post private home addresses without the express consent of the resident. Synagogue and communal venue addresses may be posted. We reserve the right to remove any address that we believe has been posted in error or without authorization.
4.5 Photos and Media
Photos and images you upload must be ones you own or have rights to use. Do not upload images containing recognizable individuals without their consent, or images of private properties without authorization.
4.6 Hours and Schedules
Minyan times, prayer schedules, and service hours you post are user-generated information. We do not independently verify accuracy. Always confirm times directly with the organizer or venue. We are not responsible for inaccurate schedule information.
4.7 Content Removal
We reserve the right to remove any User Content that violates these Terms or that we determine in our sole discretion is harmful to the community, without prior notice.
5. Acceptable Use Policy
You agree not to:
- Scrape, crawl, or harvest data from the Service
- Use automated bots or scripts to interact with the Service
- Attempt to gain unauthorized access to any part of the Service or its systems
- Interfere with or disrupt the Service or servers
- Use the Service to send unsolicited commercial messages
- Impersonate any person or entity
- Create a false identity or mislead others about your identity
- Use the Service for any unlawful purpose
- Circumvent any security or verification measures
6. Payments and Donations
6.1 Payment Processing
Payment processing services are provided by Stripe, Inc. By making a payment or donation, you agree to Stripe’s Terms of Service. We do not store your full payment card information on our servers.
6.2 Donations
Donations made through the Service are voluntary. Unless stated otherwise, donations are not tax-deductible. We are not responsible for representing tax status. Consult your tax advisor regarding deductibility.
6.3 Dues
If your organization uses the Service to collect membership dues, the terms of those dues are governed by the collecting organization. We act as a payment facilitator only and are not a party to dues agreements.
6.4 Refunds
All payments are final unless otherwise stated at the time of purchase. Refund requests must be submitted within 30 days and are subject to our discretion. Contact hello@MobileGabbai.com for refund inquiries.
7. Intellectual Property
The Service and its original content (excluding User Content), features, and functionality are owned by MobileGabbai and are protected by copyright, trademark, and other laws. Our trademarks may not be used without our prior written consent.
You retain ownership of User Content you post. By posting, you grant us the license described in Section 4.1.
8. Privacy
Your use of the Service is also governed by our Privacy Policy, available at MobileGabbai.com/privacy, which is incorporated into these Terms by reference.
9. Third-Party Services
The Service integrates with third-party providers including Twilio (SMS), SendGrid (email), and Stripe (payments). Your use of these integrations is also subject to the respective third-party terms of service and privacy policies. We are not responsible for third-party services.
10. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
WE DO NOT WARRANT THAT: (A) THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE; (B) ANY INFORMATION ON THE SERVICE IS ACCURATE, COMPLETE, OR CURRENT; (C) MINYAN LISTINGS, TIMES, LOCATIONS, OR SCHEDULES ARE ACCURATE OR UP TO DATE.
MINYAN AND EVENT INFORMATION IS USER-GENERATED. ALWAYS VERIFY TIMES AND LOCATIONS DIRECTLY WITH THE ORGANIZER BEFORE ATTENDING.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MOBILEGABBAI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM: (A) YOUR USE OF OR INABILITY TO USE THE SERVICE; (B) ANY USER CONTENT; (C) INACCURATE MINYAN OR EVENT INFORMATION; (D) UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR DATA.
OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRIOR TO THE CLAIM, OR $100, WHICHEVER IS GREATER.
12. Indemnification
You agree to defend, indemnify, and hold harmless MobileGabbai and its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of: (a) your use of the Service; (b) your User Content; (c) your violation of these Terms; or (d) your violation of any third-party rights.
13. Termination
We may suspend or terminate your account at any time for violation of these Terms, fraudulent activity, or for any other reason at our sole discretion, with or without notice.
You may close your account at any time through your account settings or by contacting us. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination shall survive.
14. Governing Law and Dispute Resolution
These Terms are governed by the laws of the United States and the state of Maryland, without regard to conflict of law provisions. Any dispute arising from these Terms shall be resolved through binding arbitration in Maryland, except that either party may seek injunctive relief in a court of competent jurisdiction.
You waive any right to participate in a class action lawsuit or class-wide arbitration.
15. Changes to These Terms
We reserve the right to modify these Terms at any time. We will notify users of material changes by posting updated Terms on the Service and updating the effective date. Continued use of the Service after changes constitutes acceptance of the revised Terms.
